Terms of Service
The agreement for using Wakivo. Short, and written to be read — the parts that could cost you something are near the top rather than buried.
Last updated 6 August 2026
- Use it on computers you own or are allowed to control. That is the one rule everything else follows from.
- A remote shutdown can lose unsaved work. The ten-second countdown is there to catch a mistap, not to make the command safe.
- We will not promise a wake will work. It depends on hardware and firmware we do not control, and the app tells you when it cannot.
- Local mode keeps working without us. It needs no account and no server, so it does not stop if we do.
1. This agreement
These terms are between you and Wakivo (“we”, “us”), and they cover the Wakivo mobile apps, the Wakivo desktop agent, this website and the Wakivo backend service. Installing or using any of them means you accept them. If you do not, do not use Wakivo. If you are using it for an employer, you confirm you may agree to these terms on their behalf.
Our handling of data is set out separately in the Privacy Policy, which forms part of this agreement.
2. What Wakivo is — and is not
Wakivo sends power commands to a computer running the Wakivo agent: lock, sleep, hibernate, restart, shut down, wake, and creating or cancelling a schedule. That list is the whole of it.
Wakivo is not a remote desktop. It does not capture your screen, send keyboard or mouse input, read or transfer files, or execute arbitrary commands. It has no mechanism to do any of those things. Do not use it as though it did, and do not represent it to others as something it is not.
3. Your licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use Wakivo on devices you own or control, for personal or internal business use. You may not resell it, rent it out, reverse-engineer it except where the law says you may regardless of this clause, remove its notices, or use it to build a competing service.
Wakivo is free to use today. If that changes, existing installations keep working.
4. Your account and your devices
Remote access needs an account; local Wi-Fi use does not and never will.
- You must be at least 13 to have an account, and give an email address that is yours.
- You are responsible for what happens under your account and for the security of the devices you have paired.
- Approve pairing requests carefully. Approving one at the computer is what grants access; a correct code alone does not. Anything you approve can power that computer off.
- Revoke a device the moment you lose it, and pause remote control from the computer if you are unsure.
- Tell us at support@wakivo.app if you think the account has been compromised.
5. Data loss — read this one
Shutting down or restarting a computer remotely can destroy unsaved work, interrupt a running job, and drop anything that was in progress on it. You are the one who decides when to send a destructive command, and you accept that risk when you send it.
The safeguards are real but they are not a guarantee. The ten-second cancellable countdown exists so that a mistap is recoverable; it does not make a deliberate shutdown safe, and it cannot rescue an application that does not save its own state. Confirmation, biometrics and the option to close applications first are all controls we give you — using them is your call, and their absence is not our fault.
Do not use Wakivo to control machines where an unexpected power-off would be dangerous.
6. What we will not promise about waking
Whether a computer can be woken over a network depends on its network adapter, its firmware settings, its operating system, and exactly which power state it is in — none of which we control. We therefore do not promise a wake will succeed. Specifically:
- A magic packet wakes a sleeping machine. Nothing on a network can start one that is fully powered off; that is what a scheduled startup is for.
- A magic packet does not cross the internet on its own — it needs something already awake on the same network to send it.
- Wake over Wi-Fi is far less reliable than over Ethernet, and a rotating private Wi-Fi address makes a stored one go stale.
- With FileVault or BitLocker on, a machine that powers on stops at the unlock screen and cannot log in unattended.
- Windows Fast Startup and hybrid sleep quietly change what “shut down” means and can break a wake that used to work.
Where Wakivo can detect one of these, it tells you rather than spinning — but a detection that comes back “possibly” means exactly that.
7. Acceptable use
You may not:
- Use Wakivo on a computer you do not own and are not authorised to control. Powering off someone else’s machine without permission is likely a criminal offence where you live.
- Use it to disrupt a service, deny someone access to their own computer, or as part of any attack.
- Try to bypass the approval step, forge or replay commands, or reach the backend other than through the apps.
- Probe, load-test or interfere with the service, or attempt to access another person’s account or devices.
- Use it in breach of any law that applies to you, including export and sanctions law.
Security research on your own devices and accounts is welcome. Tell us what you find at privacy@wakivo.app.
8. Availability
The remote service is provided as-is with no uptime commitment, and we may change, suspend or discontinue parts of it. We will give reasonable notice of a discontinuation where we can.
Two things soften that by design: local mode does not depend on us — it needs no account and no server — and schedules are held on the computer, so they still fire if the service, the internet or your phone is gone.
9. Ownership
Wakivo, its name, its logo and its software are ours and stay ours. These terms grant a licence to use it, not any ownership of it. Your own content — your device names, your schedules — remains yours; we hold it only to provide the service, as described in the Privacy Policy.
Feedback you send us may be used freely and without obligation, which is the only practical way to act on it.
10. Disclaimer
To the fullest extent the law allows, Wakivo is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that it will be uninterrupted, error-free, or that any command will be delivered or executed.
Some jurisdictions do not allow these exclusions, in which case they apply to you only as far as that jurisdiction permits.
11. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or lost unsaved work, arising from your use of Wakivo — whether or not we were told such damage was possible.
Our total liability for any claim relating to Wakivo is limited to the greater of the amount you paid us for it in the twelve months before the claim, or 50 US dollars.
Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, your statutory rights are unaffected.
12. Indemnity
You will indemnify us against claims arising from your use of Wakivo in breach of these terms, in particular from using it on a computer you were not authorised to control.
13. If you got the app from Apple
For the iPhone and iPad apps, and because Apple requires these to be stated:
- This agreement is between you and us only. Apple is not a party to it.
- We, not Apple, are solely responsible for Wakivo and for any support or maintenance of it. Apple has no obligation to provide either.
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price. Apple has no other warranty obligation, and any other claim is our responsibility.
- Apple is not responsible for addressing your claims relating to the app, including product liability, legal compliance and consumer protection claims.
- If a third party claims the app infringes their intellectual property, we, not Apple, are responsible for the defence and settlement of that claim.
- You confirm you are not in a country subject to a US embargo or designated as terrorist supporting, and are not on any US list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
- You must comply with the App Store Terms of Service in using the app.
14. Ending it
You can stop at any time by deleting your account and uninstalling the apps. We may suspend or terminate an account that breaches these terms, or where we must to comply with the law; except in serious cases we will tell you why and give you a chance to put it right. Sections 5, 9, 10, 11 and 12 survive termination.
15. Governing law
These terms are governed by the laws of Wakivo’s place of establishment, and disputes go to its courts. If you are a consumer, this does not deprive you of the protection of the mandatory law of the country you live in, or of your right to bring a claim there.
16. Changes
We may update these terms. The date at the top changes when we do, and a material change will be announced in the app before it takes effect. Continuing to use Wakivo after that is acceptance; if you would rather not, delete your account.
